The PropUp Studio website is provided by PropUp Studio for your personal use and enjoyment subject to the terms of use set forth here and all modifications thereto (“The Terms”), and future revisions by PropUp Studio. Please read these terms in full before using this website. If you do not accept these terms of use, please do not use this website. Your continued use of this website confirms your acceptance of these terms of service.

Description of Services

PropUp Studio, via the site, provides users with the ability to purchase balloons (bouquets, jumbo balloons, personalized balloons, surprise room packages, etc.), houseplants and gifts for local delivery throughout Southern Nevada.

Terms of Sale

By placing an order at propupstudio.com, you are agreeing to pay the price applicable for the product or service (including any sales taxes, surcharges, or delivery fees), and agree to the terms, restrictions, and conditions of the purchase as of the time you submitted the order. Sales Tax is not included in the price listed within the store. You will be charged the appropriate sales tax upon checkout with PropUp Studio. After placing your order, you will receive a confirmation email and a confirmation email once your order is delivered. 

Payment 

For online purchases, PropUp Studio accepts the following methods of payment. [Visa, Mastercard, Discover, American Express]. PropUp Studio does not keep credit cards on file or stored within customer accounts. Purchaser must submit credit card information for every transaction. All orders are subject to NV sales tax. You will have the opportunity to review this amount before submitting your order. PropUp Studio uses the industry’s leading security technology to ensure that your order will be safe and secure. For Event/Festival purchases, PropUp Studio utilizes Square payment processing services for the following methods of payment [Visa, Mastercard, Discover, American Express, Apple Pay, Google Pay]. PropUp Studio does not issue refunds for event/festival/on-site sales. 

Disclaimers of Warranties

PropUp Studio provides the Site and Services “as is”, “with all faults” and “as available.” We make no express warranties or guarantees about the Site, Goods, or Services. The extent permitted by law, we disclaim any implied warranties that the site and services are merchantable, of satisfactory quality, accurately depicted and described, appropriate for a particular purpose or need, and non-infringing. We do not guarantee that PropUp Studio will meet your particular purpose or need, is error-free, reliable and available at all times, and without interruption. We do not make any warranties as to privacy and security other than as expressly stated in the Privacy Policy. No oral or written information or advice given by a PropUp Studio representative shall create a warranty. 

Limitation of Liabilities

Your sole remedy for any dispute with us is to immediately discontinue your use of PropUpStudio.com. In no event shall our liability, or the liability of our Officers, Directors, Agents, Partners, and Vendors, for any and all claims relating to the use of the site and services, exceed the total amount of fees that you paid us during the previous one-year period of use for the specific service of the issue. We, our Officers, Directors, Agents, Partners, and Vendors, shall not be liable for any indirect, incidental, consequential, or special damages arising from your use, or inability to use, or reliance upon our site and services. If jurisdiction does not allow the exclusion of liability for damages, in such jurisdiction, our liability, and the liability of our Officers, Directors, Agents, Partners, and Vendors, shall be limited to the extent permitted by law. Notwithstanding anything written herein to the contrary, the Buyer and the Company acknowledge and agree that the Company (PropUp Studio) will not be liable for any losses or damages, whether indirect, incidental, special or consequential (including, but not limited to any physical/emotional damage or distress, bodily injury, death or harm arising out of your use of the products and/or services delivered to you or the recipient, irrespective of whether or not the buyer or recipient has been advised or otherwise might have anticipated the possibility of such loss or damage. 

Product Pricing and Availability

PropUp Studio reserves the right to update, edit, discontinue or modify product description and pricing at any time without notice. PropUp Studio has the right to cancel any order due to incorrect price or description, upon which the customer’s credit card will be fully refunded. 

Promotional Codes

All discount, coupon,  and promotional codes including special sale offers are only redeemable on the PropUp Studio website and cannot be used in conjunction with any other promotional activity. Only one promotional discount can be used per order, and is only valid within the time stated in the offer rules. Promotional codes have no cash value and only apply to current order. PropUp Studio reserves the right to cancel promotional codes at any time without notice. Promotional codes apply to online orders only and unless otherwise stated, are not valid for phone orders.

Order Changes and Cancellations

Orders for balloon deliveries placed online may be cancelled or changed up to 2 days prior to the scheduled delivery date.  After this period orders become non-refundable. Under special circumstances, small alterations can be made to card messages and arrangements. To make a change to your order or cancel your order, please contact us via email at hello@propupstudio.com. All order cancellations and alterations must be submitted by email only within the prescribed time period. You will receive a response from a PropUp Studio team member within 24 hours of your email. Charges will be refunded to the credit card used for the transaction. Payment refunds will show in your account within 5-10 days minus any payment processing charges.

Order Delivery Requirements

PropUp Studio offers balloon and gift delivery during the following hours: Monday – Sunday  [10a-4p] Although PropUp Studio cannot guarantee a delivery at an exact time and location we offer delivery windows in 2 hour blocks 10a-12p | 12p-2p | 2p-4p. The purchaser is responsible for confirming the permission of the delivery time and location. PropUp Studio recommends having either the purchaser or recipient onsite to receive the order. PropUp Studio does not take responsibility or issue refunds if the order is not received by someone upon delivery, or if any person or outside circumstance causes damage to the order after delivery. PropUp Studio is not responsible or liable, if the purchaser and/or the recipient of a delivery experiences any health issues or illness that follows the receiving of a balloon or gift order. Regretfully we are only able to make one delivery attempt to the location determined by the purchaser. If a delivery cannot be delivered for any reason, PropUp Studio will attempt to notify the purchaser and/or recipient. If we are unable to locate the recipient, or authorized receiver, at the time of delivery, we may leave the balloon order outside of the residence or with a nearby business or neighbor. If we do leave the order at a different nearby location, we will notify the recipient by phone or email. PropUp Studio will not make any attempts to redeliver if order is undeliverable due to restricted property access or otherwise. Un-deliverable  orders will not be refunded. PropUp Studio photographs all delivery orders upon completion for quality control purposes. PropUp Studio will always replace any balloons damaged during the delivery process before delivering to recipient. If not, a refund will be processed on the specific defective balloon. Some balloon orders are delivered in bags to protect them from dust and damage during transport. We recommend that all balloons be unbagged upon delivery to avoid any damage.

Weather and Balloon Condition

PropUp Studio will deliver balloon orders in excellent gifting condition as seen in product images. Balloons are inherently susceptible to varying temperature shifts. We recommend keeping balloons out of extreme environment conditions (direct sunlight, heat, cold, rain, high winds, etc). PropUp Studio is not responsible for damage to balloons after delivery. Balloons that appear glossy when delivered will naturally oxidize and age. Balloons that arrive matte or opaque in color do so by design. Colors will change at different rates in accordance with their original color and initial filled capacity. Please refer to our Balloon Care Guide.

Balloon Safety

  • Natural latex rubber from latex balloons can cause allergic reactions in some individuals. 
  • PropUp Studio does not recommend, promote or condone latex or foil balloon releases. 
  • Adult supervision is required at all times when children are in the presence of un-inflated or popped balloons. Un-inflated balloons present a choking hazard when handled inappropriately.
